Highway Car Accidents Involving Pedestrians in Jackson
Exiting your vehicle on the side of a road can be extremely risky. In fact, most jurisdictions have laws prohibiting pedestrians from walking on or near roadways. When you exit your vehicle in a travel lane or on a narrow shoulder, you may be violating pedestrian right-of-way laws and could face citations for impeding traffic flow or creating a hazardous condition. These violations can result in fines, points on your driving record, and in some cases, criminal charges if your actions contribute to an accident.
If your decision to exit the vehicle results in an accident, you could face substantial personal injury lawsuits from other drivers, passengers, or pedestrians who are harmed. Courts often apply comparative negligence principles, meaning that even if another driver was speeding or distracted, your decision to create an unexpected hazard by exiting your vehicle could make you partially or wholly liable for resulting damages.
Insurance companies may also deny coverage or seek subrogation if they determine that your actions were unreasonably dangerous, potentially leaving you personally responsible for medical bills, property damage, and pain and suffering awards that can reach into the hundreds of thousands or millions of dollars.
Additionally, if you exit your vehicle and are struck, your own insurance coverage may be limited or denied entirely. Many auto insurance policies contain exclusions for injuries sustained while outside the vehicle, particularly when the insured person’s actions are deemed to have contributed to the incident. The legal doctrine of assumption of risk may also apply, meaning that by voluntarily placing yourself in a known dangerous situation, you may be barred from recovering damages even if another party was negligent. This creates a scenario where you could face both significant out-of-pocket medical expenses and potential liability to others, making the simple act of exiting your vehicle on a roadside an extremely costly legal gamble.
