Case Study:Wrongful Death Settlement for 18-Wheeler Accident Case
Case Overview
We represented the surviving family of a young adult who was killed in a nighttime collision with a multi-state motor carrier operating throughout the South and Midwest. The carrier hauled mixed freight across regional and long-haul routes.
Although not a national mega-fleet, the company maintained full interstate authority, a multi-state dispatch system, and the safety and compliance responsibilities expected of a commercially active trucking operation. The case resulted in a confidential settlement for the family.
The Incident
The collision occurred at night on a major interstate. Initial reports suggested that our client had rear-ended an 18-wheeler, a circumstance that often creates significant legal challenges in wrongful death litigation.
Our investigation revealed a very different set of facts. The commercial driver had illegally parked the tractor-trailer on the interstate, one of the most hazardous maneuvers a commercial driver can attempt and a clear violation of industry safety rules.
At the time, roadway conditions included flooding. Despite these conditions, the driver failed to take a prior exit and instead stopped the vehicle in an active traffic lane on a major roadway.
Key Legal Challenges
Because the collision initially appeared to be a rear-end crash, the defense focused on placing responsibility on our client. Overcoming this required establishing that the illegally parked tractor-trailer created an unavoidable hazard for approaching drivers.
Additional complications arose from the commercial driver’s lack of English proficiency. In violation of FMCSR requirements, she was unable to speak, read, or understand English. The crash report documented that the responding officer could not communicate with her and had to rely on a translation app to complete the investigation.
This communication barrier directly affected her ability to operate safely on interstate highways and raised serious concerns about the carrier’s hiring and qualification practices.
How Giddens Law Firm Built the Case
Our truck accident team conducted a comprehensive investigation that included accident reconstruction, ECM and EDR data downloads, and physical damage analysis. This evidence established that the tractor-trailer had been unlawfully parked on the interstate and that the maneuver directly caused the collision.
We also examined the carrier’s hiring, qualification, and oversight procedures. This review identified gaps in training and safety management that allowed an unqualified, non-English-proficient driver to be placed in interstate service.
These findings demonstrated systemic failures within the company’s operations and showed that the crash resulted from preventable management and supervision deficiencies, not driver error by our client.
The Result
As the evidence developed, the defense was required to reassess its initial position, which had focused only on superficial aspects of the crash.
Through a targeted litigation strategy and thorough development of liability and damages, we secured a confidential settlement for the family.
The resolution also addressed unsafe hiring, training, and operational practices that had placed an unqualified driver on an active interstate, helping to prevent similar tragedies in the future.
