Case Study:
Head-on Truck Collision Caused by Lane Departure
Location: Attala County, Mississippi
Parties: Yanet Blanco Mojena, Individually and on Behalf of the Wrongful Death Beneficiaries of Raul Rosquete Perdomo
Settlement: $930,000
Case Overview
We represented the family of a commercial truck driver who was killed in a catastrophic head-on collision involving a Mississippi-based regional motor carrier operating throughout the Southeast. The company hauled general commodities, building materials, and agricultural loads across Mississippi and surrounding states and operated under full interstate authority with FMCSA compliance responsibilities.
The case arose from a fatal lane-departure crash and resulted in a $930,000 settlement for the surviving family.
The Incident
This case arose from a devastating 18-wheeler versus 18-wheeler collision in Attala County, Mississippi, which claimed the life of a commercial truck driver.
The crash occurred when a tractor-trailer operated by Michau Trucking, LLC crossed the center line, causing a violent head-on impact and post-collision fire. The collision was catastrophic, and both vehicles were heavily damaged by fire.
Key Legal Challenges
Head-on collisions involving commercial vehicles often require prompt and technically detailed investigation to establish liability. In this case, it was essential to determine whether the lane departure was caused by driver error, mechanical failure, or other contributing factors.
In addition, the carrier’s insurance program included layered commercial coverage, which required careful coordination and documentation to present the full scope of liability exposure and damages.
How Giddens Law Firm Built the Case
As soon as Giddens Law Firm was retained, our truck accident lawyers moved quickly to protect the family’s interests and to make clear that this matter would be aggressively pursued. We immediately filed suit in the Circuit Court of Attala County, Mississippi, so the insurance carrier and the motor carrier understood that this was not a case that would be delayed or undervalued.
Early litigation pressure ensured the claim was taken seriously and positioned the case for prompt resolution.
Within 24 hours of obtaining the case, we had an experienced accident-reconstruction team on scene. Working closely with that team, we focused on securing the crash site, documenting physical evidence, analyzing roadway markings and debris patterns, and preserving all available evidence before it could be lost or altered.
The investigation confirmed that our client was operating his tractor-trailer safely within his lane when the Michau Trucking vehicle crossed the center line and struck him head-on. The physical evidence supported a clear and unjustified lane departure by the at-fault driver. Liability was strong and well supported.
The Result
The available insurance coverage was approximately one million dollars. By moving early and applying meaningful litigation pressure, we were able to resolve the case for $930,000, intentionally preserving a portion of the available coverage for other, less substantial claims arising from the incident. This approach allowed our clients to obtain a substantial recovery without unnecessary delay or uncertainty.
The outcome reflected accountability for failures in driver oversight, safety management, and operational supervision that contributed to the loss of lane control and the resulting collision.
