Case Study: Truck Accident Case Against a Large Interstate Logistics Carrier

Case Overview

We represented an individual who suffered serious injuries in a collision involving a large interstate and cross-border freight carrier operating under a national logistics brand. The company hauled expedited freight and other time-sensitive shipments throughout the United States and Mexico. It operated long-haul and regional routes with a sizable tractor-trailer fleet and relied heavily on cross-border commercial drivers.

The case involved English-language violations, unsafe highway re-entry, and a layered corporate structure with multiple related entities. It was resolved with a confidential settlement.

The Incident

The crash occurred late at night in Mississippi when two commercial drivers employed by the carrier pulled their tractor-trailer onto the interstate shoulder for a restroom break.

Federal regulations require drivers operating on interstate highways to read and speak English well enough to communicate with law enforcement, understand traffic signs, and operate safely. In this case, the crash report noted that the driver could not speak English and that the responding trooper used a translation application to complete basic roadside questioning. This confirmed that the driver did not meet FMCSA English-language proficiency requirements.

After stopping on the shoulder, the drivers attempted to re-enter the interstate at approximately 19 to 25 miles per hour on a 70-mile-per-hour roadway. This slow re-entry placed the 18-wheeler directly into our client’s lane, leaving no time to avoid impact.

Key Legal Challenges

During litigation, both drivers initially admitted that they had stopped for a restroom break. After meeting with defense counsel, their explanation changed to claim they had pulled over because they heard a noise.

Sorting out what actually happened required careful reconstruction and electronic data analysis. The carrier also operated through multiple related companies that shared dispatch, safety oversight, and equipment control. Untangling responsibility across this structure required coordinated discovery and close review of records from several affiliated entities, each attempting to limit its exposure.

How Giddens Law Firm Built the Case

Our Mississippi truck accident attorneys carried out accident reconstruction, downloaded ECM and EDR data, and reviewed physical evidence from the scene. The electronic data and reconstruction findings did not support the later claim that the drivers had stopped due to mechanical concerns.

We also conducted multilingual depositions using remote technology and required the production of operational and safety documents from multiple related companies. This discovery showed how dispatch decisions, safety oversight, and driver supervision were handled within the carrier’s cross-border operations.

By presenting clear evidence of English-language violations, unsafe highway re-entry, and shifting driver accounts, we strengthened the liability case and clarified responsibility across the corporate structure.

The Result

Through detailed reconstruction, regulatory review, and cross-border discovery, we secured a confidential settlement for our client.

The settlement held the carrier responsible for English-language violations, unsafe re-entry onto a high-speed interstate, and shifting post-crash explanations that were contradicted by electronic data and physical evidence.
